What a notice must contain
Under 17 U.S.C. § 512(c)(3), a notice must be in writing and include:
- your physical or electronic signature, or that of a person authorized to act for the owner;
- identification of the copyrighted work you say has been infringed;
- the address of the story or material on Page Turn you say is infringing, enough for us to find it;
- your address, telephone number and email address;
- a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law;
- a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.
Repeat infringers
We remove material identified in a valid notice. We keep a separate count of copyright takedowns. An account that receives repeated valid copyright notices loses publishing privileges, and in appropriate circumstances the account is closed.
Counter-notices
If you believe your story was removed by mistake or misidentification, you may send a counter-notice to the agent above. Under 17 U.S.C. § 512(g)(3), it must be in writing and include:
- your physical or electronic signature;
- identification of the material that was removed, and the address where it appeared before it was removed;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which Siphon Music and Games, LLC may be found), and that you will accept service of process from the person who sent the notice, or their agent.
We send a copy of the counter-notice to the person who sent the notice. Unless our agent hears within 10 business days that they have filed a court action to keep the material down, it can go back up 10 to 14 business days after we received the counter-notice, and the takedown no longer counts toward the repeat-infringer count.
Knowingly misrepresenting that material is infringing, or that it was removed by mistake, carries liability under 17 U.S.C. § 512(f).
